Luhansk Court Compels Russia to Pay $1.6 Million for Seized Sunflower Seeds

A commercial court in the Luhansk region has issued a binding order requiring the Russian state to compensate a Ukrainian private company for significant financial losses. The ruling mandates that Russia pay approximately 1.6 million US dollars, equivalent to 65.36 million hryvnias, to Oliiar. The company suffered the loss of a large stockpile of sunflower seeds when its storage facility in the occupied town of Svatove was taken over by occupying forces.
The dispute traces its origins to the autumn of 2021, when Oliiar entered into a purchase agreement for 4,700 tonnes of sunflower seeds from the 2021 harvest. The seller in this transaction was Prydniprovske Agrarian Company LLC. To manage logistics, Oliiar contracted Svatove-Ahro LLC to handle the storage of the agricultural product. The supplier fulfilled its obligation by delivering the entire consignment to a warehouse in Svatove operated by the storage provider.
By the time the full-scale invasion began on February 24, 2022, the logistics process was partially complete. The storage facility had already transferred 2,592 tonnes of the crop to Oliiar. This left a remaining balance of 2,107 tonnes held in the Svatove warehouse. Following the start of the invasion, Russian armed groups seized control of the warehouse premises, effectively taking possession of the remaining inventory. Oliiar was never able to recover that portion of its purchase, resulting in a direct financial hit to the business.
In its written decision, the court accepted the evidence presented by Oliiar as conclusive. The judges determined that the loss of the crop was a direct consequence of Russia's armed aggression. Consequently, the court ordered the Russian Ministry of Justice, which represents the state in such matters, to provide the compensation. The specific amount of 65.36 million hryvnias was calculated based on an expert valuation of the lost goods.
Oliiar is a registered private entity based in Pustomyty, located in the Lviv region. The company is founded by Iryna Zalizna, with Iryna Podoba serving as its director. This victory marks a significant legal win for a private enterprise seeking restitution for assets lost in occupied territories.
This ruling is not an isolated incident for the court. It follows a similar decision issued by the same judicial body earlier this year. In that prior case, the court ordered Russia to pay approximately 1.25 million US dollars, or 51.67 million hryvnias, to Trading House Agrokhim LLC. That compensation covered property lost in two separate locations: Svatove in the Luhansk region and Kakhovka in the Kherson region.
The case highlights the ongoing legal efforts by Ukrainian businesses to secure financial recourse for losses incurred during the conflict. While the court has established liability and set the compensation amount, the process of collecting these funds from the Russian state remains an open question. The decision underscores the role of commercial courts in adjudicating disputes involving state actors and private enterprises in the context of armed conflict.
